The ABGB (Austrian Civil Code), originally passed in 1811, is celebrating its 200 year birthday this year. The provisions governing the law of damages in section 30 (§§ 1293 ff) still continue to correspond with the unmodified original version; this is in particular true of the central provision in § 1325 ABGB on personal injury. Following the tragic glacier funicular railway disaster in Kaprun in November 2000, a shift in thinking has also taken place in Austria with regard to whether damages may be awarded for any grief and nervous shock suffered by close relatives following a death caused by a third party. The Oberste Gerichtshof (Supreme Court) has since heard a number of groundbreaking cases, which will be presented and discussed (also in international comparison) by the speaker - who has been a member of the Supreme Court for 1½ decades.
