For many years in the past, foundations played a significant role in Liechtenstein's success story. They have, however, fallen slightly into disrepute during the economic and financial crises of recent years. This has regrettably led to the present situation in which many foundations are being deleted from the register. This in turn raises legal issues and problems with which practitioners have yet to deal with, or have only dealt with negligibly.
Due to these developments, this year's foundation law conference will concentrate on existing foundations, and is in particular dedicated to issues of civil and company law concerning their management and winding up. Issues concerning the much discussed structuring possibilities available on establishing a foundation will only be dealt with on the periphery.
The conference will begin by raising and discussing problems in the field of conflict of laws in conjunction with the recognition of Liechtenstein foundations. This will be followed by a presentation in which participants will gain an overview of the most recent case law of the Liechtenstein courts.
Subsequent lectures by the speakers will address the interfaces between foundation and civil law, and essential contractual issues and questions regarding the duties of foundation council members will be tackled.
The afternoon will be dedicated to the topics of organisation and management of foundations, which will begin with the topic of governance in Liechtenstein and Austrian (private) foundations. In addition to a discussion of the duties imposed on the foundation council in cases where there are no more beneficiaries or generally where a foundation is wound up, the emphasis will be placed on criminal law issues in the context of foundations during the final time slot of the 6th Liechtenstein foundation law conference programme.
Both segments of the conference programme will each be rounded off with an interactive panel discussion.
