The New Foundation Law - 5 Years On: Developments in Corporate Ownership, Liability, Recognition and Philanthropy

Liechtenstein foundation law was introduced as part of the Persons and Companies Act in 1926. The first complete reform of this law came into force on 1 April 2009. Not only did the reform integrate established case law into statutory law, it also introduced entirely new provisions required due to the long existence of the foundation law.

In celebration of the reformed foundation law's 5th anniversary, a symposium was held on 2 April, in which the impact of the new foundation law was examined from a range of different perspectives. The symposium was organised by the University of Liechtenstein in cooperation with the Ministry of Home Affairs, Justice and Economic Affairs, the Office of Justice, the Vereinigung liechtensteinischer gemeinnütziger Stiftungen e.V., the Liechtenstein Chamber of Lawyers and the Liechtenstein Institute of Professional Trustees and Fiduciaries.

Following the symposium, this year's Annual Convention on Foundation Law is devoted to the developments and challenges which have been brought about by the new foundation law.

Taking into account the legal issues raised at the symposium, the contents of the conference are divided into two parts. In the morning, the speakers will address issues concerning corporate and self-purpose foundations, the liability of foundation council members and the recognition of Liechtenstein foundations abroad. While special emphasis will be placed on recent judgments in the first part, the supervisory practices of the STIFA will be considered in the afternoon. In addition, issues concerning foundation governance and supervision, the possible methods of avoiding liability by foundation council members and mission-related investment will be explained in detail in the second part of the conference.

The presentations will be rounded off by three panel discussions, which will complement the presentation topics by focusing on the "Interaction between politics, economics and law in the philanthropic sector in the German-speaking legal systems".
