Protected Cell Foundations - Recognition - Asset Management - Succession Planning - Philanthropy

The introduction of protected cell companies, as a business organisation form, into the Liechtenstein Persons and Companies Act with effect as of 1 January 2015 entails radical changes for foundation law. This particular form of liability limitation, which has not been alien to the PGR in the past, can now also be used in connection with foundation law, which opens up interesting structuring opportunities for the non-profit sector in Liechtenstein in particular.

In light of this statutory amendment, the 8th Liechtenstein Annual Convention on Foundation Law will be dedicated to the topic of protected cell foundations. It will include reports from international experts dealing with protected cell companies about their experiences and thus provide an insight into the use of this particular form of liability limitation in other jurisdictions. Based on these explanations, they will apply their knowledge to the newly introduced Liechtenstein protected cell foundations.

Emphasis will also be placed on philanthropy as one of the key areas in which protected cell foundations will be used. In this context, the legal challenges in foundation law and the duties and liability of a foundation council arising in connection with the management of assets will be analysed.

At this year's Annual Convention on Foundation Law, two further topics, namely succession planning and international recognition, will also take centre stage. Special emphasis will be placed on the inheritance law aspects of succession planning, the use of holding foundations and new case law on the recognition of Liechtenstein structures in Germany.

In the tradition of previous events, a presentation will also be dedicated to current case law on Liechtenstein foundation law matters.

The presentations on the various topics blocks are rounded off by three panel discussions, in which conference attendees are welcome to participate with questions arising in practice.
