Content

Compliance has developed into a topic which is ever present in Liechtenstein's financial centre in recent years. Due to numerous legal innovations - especially at European level, it is necessary for the EU and EEA Member States to continually revise their legislation. At the same time, companies are faced with soft law recommendations on conduct and must position themselves in this area. Against this backdrop, special attention will be paid to good governance, white-collar crime and combating money laundering at Compliance Day 2016.

The focus of the first conference presentation will be placed on risk management, internal control systems and compliance as core components of good governance. The subsequent speaker will address the question of whether conduct risk should be regarded as 'the new compliance'. The session on the topic of good governance will be concluded with an issue of immense importance for practitioners in Liechtenstein, namely that of fraud prevention in connection with the profession of a compliance officer.
The morning session will be concluded with a panel discussion on the topic of 'Is law always righteous?' The panel will be hosted by Yves Hollenstein, editor-in-chief of 'Wirtschaft regional' and participants will discuss the interplay of good governance, compliance and ethics.
In relation to white-collar crime and combating money laundering, the afternoon session's first speaker will discuss academic and practical insights into how to deal with white-collar crime in companies. Thereafter, representatives of the Financial Market Authority Liechtenstein will present the legislature's view on the current implementation status of the 4th Anti-Money Laundering Directive in Liechtenstein, thus addressing a highly topical and controversial issue for the future development of Liechtenstein's financial centre. A contribution from the Financial Intelligence Unit on practices in relation to the reporting system and one on the practical experiences of police in relation to white-collar crimes will round off the subject. The event will be concluded with a presentation of current case law concerning financial criminal law.
