The European refugee crisis has led asylum authorities, lawyers and voluntary organisations to concentrate more intensively on asylum law. Furthermore, immigration law also continues to play a significant role.
The presentation will address the issues which arise in the context of this complex area of law and in particular discuss the conditions under which asylum must be granted, asylum status can be withdrawn and legal aid can be granted or rejected in light of case law developed by the Constitutional Court and the Supreme Administrative Court. Furthermore, the most recent decisions of these two courts in relation to the proportionality test in the law governing the right of residence will be examined.
