First Dr. iur. Wilhelm Ungerank, L.L.M., Judge at the Princely High Court, in Vaduz, will explain the current EFTA Court's case law on the right of the insured to a free choice of lawyer under the Solvency II Directive (Case E-21/16 Pascale Nobile vs. Das Rechtsschutz-Versicherung AG) and the implications of this judgment on insurance companies in the Principality of Liechtenstein.

The symposium will mainly focus on the latest EU- and EEA case law with regards to the internal market legislation. Critical - and to some extent new - legal issues are raised, particularly in the services sector, e.g. in the areas of the so-called digital economy and financial services. The purpose of the event is to systematically present and critically analyse the most important European rulings on fundamental freedoms. Based on current case studies - for instance, the cross-border transformation of companies without relocation of the de facto head office or the limits of qualified holdings in banks and insurance companies - tendencies that can be outlined and problems that could arise in the future will be identified.

Dr. Luigi Malferrari is a member of the Legal Service of the European Commission in Brussels; he works mainly in areas of free movement of capital, freedom of establishment and free movement of services. Since 2004 he has been teaching EU law and fundamental freedoms at the Robert Schuman University in Strasbourg and since 2013 at the EBS in Wiesbaden. He used to be a legal administrator at the ECJ and prior to that he worked as a lawyer in an international law firm.
