The presentation deals with selected recent rulings of the Austrian Supreme Court on civil procedure. In this context, the focus is laid on general fundamental issues. The rulings to be presented range from the requirements of the determination of the lawsuit through the set-off to issues related to appeal rights, like in case of procedural shortcomings or in procedures allowing provisional injunctions. Numerous rulings concern the procedures of taking evidence. This includes central questions such as the standard of evidence, that is, the required degree of judicial conviction, the (factual) immediacy principle or the use of evidence from other procedures. These questions were recently raised mainly (but not only) in connection with investor lawsuits.
