Innovations in the national and international foundation landscape

Traditionally, the programme of Annual Convention on Foundation Law starts with a review of the current case law and developments of the decision-making practice of the Foundation Supervisory Authority (STIFA). In the second part, stock will first be taken from a comparative law perspective on the occasion of the 30th anniversary of the Austrian private foundation. The view of the neighbouring foundation law systems is rounded off with the reform of the German foundation law, before the the recent case law of the Liechtenstein courts on the party status of beneficiaries in supervisory proceedings is dealt with. The subsequent panel discussion will be devoted to selected issues in the field of Liechtenstein foundations and will round off the first part of the thematic block on developments in and around Liechtenstein as a foundation location.

The afternoon programme starts with the areas of digitalisation and sustainability. This will include a look at the role of the foundation as a will substitute with a special focus on digital assets and the new challenges for foundation boards due to the questions surrounding the sustainability debate.

In the following philanthropy section, current issues related to consumption foundations and digitalization in the foundation sector will be discussed. The subsequent panel provides an opportunity for discussion on these and other new areas of interest.

The second part of the section on developments in and around Liechtenstein as a foundation location will examine the limits of the representation power of the foundation board as well as the subsequent inclusion of beneficiaries by the foundation board. It will be rounded off with a look at current developments in the Swiss foundation landscape.

Lawyers, trustees, judges, public prosecutors, employees in banks, insurance companies and financial service providers, jurists as well as any people interested in specifically gaining an understanding of foundation law issues.
