In the scope of the 24th Jurisdiction Symposium on 4 July 2013, the President of the EFTA Court, Professor Carl Baudenbacher, will talk about the new developments in case law at the EFTA Court in Luxembourg, in particular about the recent judgement on the question of insurance companies’ duty to inform and disclose.

Lawyers, trustees, auditors, judges, prosecutors and corporate and public-sector legal departments are facing growing challenges. Therefore, up-to-date knowledge and understanding of recent case law is vital to successful practice. The Chair of Company, Foundation and Trust Law at the University of Liechtenstein is therefore hosting the 24th Jurisdiction Symposium as a compact and tailored form of continuing education on Thursday, 4 July 2013, from 6 p.m. 

Competition, procedural law and insurance law

In recent years, the EFTA Court has dealt with between 15 and 20 applications annually, including landmark cases such as Norwegian Post, DB Schenker and Icesave. Professor Baudenbacher will pay special attention to three areas in the course of his lecture: decision-making practice in competition law, changes in procedural law and the legal consequences of the financial crisis in Iceland. 

He will discuss in particular the very recent ruling of the EFTA Court on 13 June 2013 concerning the question of insurance companies’ duty to inform and disclose in the case of contracts concluded through insurance brokers. This continuing education event will also focus on the court ruling regarding damages in the event of these duties to inform being violated. In the area of procedural law, President Baudenbacher will address specifically the supreme courts’ obligation to refer and the legal nature of preliminary rulings. 




At a drinks reception following the lecture, participants will have the opportunity to talk with President Baudenbacher and Professor Francesco A. Schurr, who holds the Chair of Company, Foundation and Trust Law at the University of Liechtenstein, ask individual questions and discuss the issues more deeply. The Jurisdiction Symposia are actively supported by the Liechtenstein Chamber of Lawyers, the Association of Liechtenstein Judges and the Liechtenstein Association of Professional Trustees.
