Content

The demands placed on lawyers, trustees, auditors, judges and public prosecutors as well as legal staff in business and civil service are constantly growing. It is therefore essential for practitioners working in a legal work environment to gain knowledge of current relevant case law.

The two most dynamic intellectual property rights, copyright and trademark law, are significantly influenced by court decisions. The fact that Liechtenstein is affected by both European case law and the national case law of neighbouring countries is evident considering the numerous individual and economic connections with foreign countries. Against this background, the speaker will present selected case decisions concerning copyright and trademark law, explain their relevance in practice and specifically address the following topics:

  • Permissibility of hyperlinks on the Internet
  • Restricting access to web content provided in breach of copyright
  • Liability for providing open Wi-Fi networks
  • Distinctive character of (shape) marks
  • “Scope“ of protection of identity and reputation

Professor Manfred Büchele is a distinguished expert in the field of intellectual property rights. The focus of the lecture will be on current case law; recent legislative developments will also be discussed.
