Compliance in the area of tension between digitalisation and new criminal offences

In the recent years, compliance has emerged as a constantly present topic in the Liechtenstein financial centre. The responsibilities of the compliance officer can range from securities compliance, money laundering prevention, data protection compliance, antitrust compliance to fraud. A compliance officer is challenged more than ever. At the same time, the personal liability of the compliance officer is strictly regulated. The first presentations will lay focus on the position and liability of the compliance officer, compliance standards and liability and the certification of compliance management systems. A compliance certification can be very beneficial for internationally active companies. It not only provides a certain competitive advantage in tenders, but also raises the overall compliance awareness. Building on this, the first case-law on (the terms of confiscation and) forfeiture and the issue of fraud in companies and risk management will be examined. The morning programme will conclude with a panel discussion on the liability of the compliance officer, moderated by Prof. Dr. Nicolas Raschauer. This will give the participants the opportunity to deepen the topic with individual questions.

Digitalisation and new technologies such as big data analyses and blockchain are starting to spread more and more in the legal and compliance industry. The third thematic block will examine cyber risks and operational IT-risks as well as digital compliance for companies. Finally, the far-reaching implications of MiFID II for the compliance function will be examined in detail. The effects of MiFID II are of particular interest with regard to the legal position and the area of responsibility of compliance.

Target Audience

Compliance officers in banks, insurance companies, funds and other financial service providers, lawyers, trustees, auditors, employees of administrative authorities as well as commercial and industrial companies who are interested in a well-founded further training in the area of compliance and have to do with it in their everyday professional life at present or in the future.
