5th Liechtenstein Convention on Foundation Law

The 5th Liechtenstein Convention on Foundation Law, organized by the Chair of Company, Foundation and Trust Law, will be held on Wednesday, 24 October 2012. The convention will be discussing the topic of “Changes in substantive foundation law and cross-border law enforcement by courts of arbitration”.

The 5th Liechtenstein Convention on Foundation Law, organized by the Chair of Company, Foundation and Trust Law, will be held on Wednesday, 24 October 2012. The convention will be discussing the topic of “Changes in substantive foundation law and cross-border law enforcement by courts of arbitration”.

This year’s Convention on Foundation Law will examine current topics in substantive foundation law as well as procedural issues. In the morning, Francesco A. Schurr, Wilhelm Ungerank, Karl Josef Hier, Marco Ender and Helmut Schwärzler will deliver speeches, starting with an overview of the latest developments in case law and focusing on the most recent judgements. Subsequently, complex issues related to corporate foundations will be analysed, and the dismissal of Foundation Boards will be explored. The programme will go on to discuss beneficiary rights and their international enforcement at ordinary courts. In the afternoon, Hubertus Schumacher, Peter Wolff and Mario A. König will take a look at arbitration in relation to foundations, concentrating on the new Liechtenstein rules of arbitration. In order to assess the potential of arbitration for foundations in Liechtenstein, the invited international experts Felix Dasser, Katharina Müller, Manuel Liatowitsch and Gerold Zeiler will speak about models and practical experiences related to arbitration concerning foundations in the neighbouring countries Switzerland and Austria.

Questions and examples from participants’ own practical experiences
Both parts of the convention will be concluded by an interactive panel discussion, which will address additional questions and statements and specify approaches to solutions. This year’s convention has been organized in cooperation with the Liechtenstein Arbitration Association and the Institute for Civil Proceedings at the University of Innsbruck’s Faculty of Law.
