Foundations – developments and prospects

The 22nd Jurisdiction Symposium on the topic “Dismissal of foundation boards” will be held on 21 March 2013. The visiting speakers will be Professor Georg E. Kodek, LL. M., Professor for Civil and Business Law at the Vienna University of Economics and Business Administration and justice at the Supreme Court in Vienna, as well as Dr. Gert Delle Karth, President of the Princely Supreme Court.

The 22nd Jurisdiction Symposium on the topic “Dismissal of foundation boards” will be held on the campus of the University of Liechtenstein on 21 March 2013. The visiting speakers will be Professor Georg E. Kodek, LL. M., Professor for Civil and Business Law at the Vienna University of Economics and Business Administration and justice at the Supreme Court in Vienna, as well as Dr. Gert Delle Karth, President of the Princely Supreme Court.

The issue of the removal of foundation board members has become the focus of increased attention in connection with the generational transition currently occurring in many private foundations as well as in connection with the economic crisis. In this context, the degree to which the right of removal as the most important means of influencing the management of a foundation can be transferred to an advisory board or similar body, is also relevant. The Princely Supreme Court has recently handed down several decisions on this. 

The 22nd Jurisdiction Symposium of the Chair of Company, Foundation and Trust Law at the Institute for Financial Services of the University of Liechtenstein will address this current topic on Thursday, 21 March 2013, starting at 6 p.m. Professor Georg E. Kodek’s speech will provide an overview of recent case law in Austria and Liechtenstein and present developments and prospects. The President of the Princely Supreme Court, Dr. Gert Delle Karth, has agreed to participate in the panel discussion which will follow Professor Georg E. Kodek’s speech. Conference report on the topic 

The report on the 4th Liechtenstein Annual Convention on Foundation Law 2011, which was recently published by Professor Francesco A. Schurr, Chair of Company, Foundation and Trust Law, deals with a related topic. Contributions from experts on the rights of founders and beneficiaries, non-profit foundations in the stressful area of generational transition as well as the effect of arbitration awards can be found in the compendium “Der Generationenwechsel in der Stiftungslandschaft” (“Generational transition in the case of foundations”), published by Schulthess Verlag in Zurich.
