On 1 April 2009, the new foundation law came into force. At the time, Liechtenstein foundations were the focus of much international discussion. The new foundation law, in particular its governance provisions, is often referred to by foreign experts as leading edge legislation in the midst of European foundation law, and has created new avenues and opportunities for the foundation sector.

The new foundation law has now been tested in practice for 5 years. There is now occasion to celebrate on the one hand, but also to raise critical questions about the existing legal situation on the other. The speakers will first discuss the positive and negative aspects of the new foundation law from a domestic perspective. In so doing, weak spots will be illuminated, and the question as to a possible need for reform will be discussed. Subsequently, the spotlight will be directed towards foreign legal systems, which are still reluctant to recognise Liechtenstein foundations as legal entities. It is imperative for the Liechtenstein foundation to intercept this trend towards non-recognition. Therefore, this will be one of the key challenges in the development of foundation law in the future. In the subsequent panel discussion, there will be an opportunity to delve into the subject with individual questions.
