International Developments in Trust Law: Reforms, Supervision, Shams and Validity, Wealth Structuring, Recognition and Confidentiality

The trust concept is currently experiencing a surge in popularity around the globe. In order to keep pace with such demand, a number of countries have introduced new legislation and/or amendments to existing law. In the first conference session, these developments will be discussed from the standpoint of various jurisdictions.

The emphasis of the second conference session will be placed on the 'life' of a trust. Practical cases regarding discretionary trusts and supervision by the court on the one hand and the conditions under which courts may consider a trust to be a sham or otherwise void on the other hand will be presented.

The growing interest in trusts worldwide stems from its flexible use for the purposes of wealth structuring and asset protection. The degree to which certain jurisdictions and whether domestic or foreign trusts are best suited to such purposes will be covered in the third conference session.

Furthermore, issues regarding the recognition of trusts will also be discussed. The conference will close with a presentation and a panel discussion on issues concerning trust confidentiality.
The conference presentations will be given by internationally renowned practitioners and academics.
