On 1 June 2016, the amended provisions governing confiscation (§ 19a of the Criminal Code) and forfeiture (§§ 20ff of the Criminal Code) entered into force in Liechtenstein. The new legal modifications are, in particular, necessary due to the ratification of the Council of Europe Criminal Law Convention on Corruption on 17 November 2009 and the Evaluation Report submitted by GRECO on 21 October 2011. These changes provide new and sometimes very far-reaching opportunities to recover criminal proceeds from offenders, but also under certain circumstances from third parties. One example is the option provided under the new legal provisions of confiscating the car used by a money launderer for the purposes of committing the offence.

The new provisions are based on the model provided by Austrian law, albeit with changes to the Austrian rules governing forfeiture, which have been regarded very critically. In this regard, an overview of the requirements and options for their application will be provided and issues of demarcation discussed. The limitations of the new provisions will also be examined

At this Lunch & Learn, Prof Dr Alexander Tipold, Professor at the Institute for Criminal Law and Criminology at the University of Vienna, will give participants a detailed overview of the new provisions concerning confiscation (§ 19a of the Criminal Code) and forfeiture (§§ 20ff of the Criminal Code). As part of the lecture, the permissibility of the new rules will be discussed in detail in relation to the procedural guarantees established in the Criminal Procedure Code and the guarantees set out in Art. 6 of the ECHR.
